Stephen Fusco is of counsel with Scoggins & Goodman, P.C. Stephen has practiced primarily in the areas of real estate and corporate matters, including land use and zoning issues, throughout his career. He routinely represents developers and lenders regarding zoning/land use approvals, the drafting of complex contracts, service delivery strategy agreements, leases, lending instruments, asset purchase agreements, foreclosures, dispossessory and other corporate/securities documents.
As a result of his special expertise in zoning matters, Stephen works with state and local governments and administrative agencies on zoning, special land use permit and variance approvals; annexation and de-annexation of land; Development of Reginal Impact (DRI) review; and the adoption of zoning ordinances, text amendments and comprehensive plans. Stephen routinely appears before local governments regarding zoning matters, liquor licenses, subdivision platting, certificates of appropriateness, impact fees, sign permits, intergovernmental agreements, service delivery strategy agreements, and other land use related permitting issues.
Stephen's administrative practice is complemented by his experience in the courtroom which includes real estate litigation, condemnation matters, landlord/tenant disputes, appeals of zoning decisions, ADA and FHA issues, Section 1983 claims and other matters.
Stephen currenty serves as Fulton County's alcohol license hearing officer and hears appeals regarding the issuance of liquor licenses.
Stephen is a member of the State Bar of Georgia and the National Community Association Institute. Stephen is actively involved in the community and currently serves on the Advisory Board of the Barton Child Law and the Alumni Advisory Board of OutLaw, Emory Law School's gay and lesbian student organization. Additionally, Stephen works with the following organizations: Kids in Need of Dreams - Truancy Intervention Project ("TIP"), Special Olympics Volunteer and the State Bar of Georgia Diversity Committee.
